Permitted Development and Flats or
Apartments - Oct. 1st 2008.
Flats now benefit from limited permitted
development rights but only for satellite and other
antennas.
Most of these permitted development rights do not apply to
flats or listed buildings, and the limits are more restrictive
for houses in conservation areas.
For many modern houses, conditions of the original planning
permission for the house remove some or all of these
rights.
For the purposes of permitted development a dwelling house
does not include a building containing one or more flats, or a
flat contained within such as building.
There are currently no Permitted Development
Rights (PDR) for flats or buildings containing
flats (other than in
relation to satellite and other antennas) where the more
intensive levels of occupation and different property
ownership arrangements could lead to particularly
problematic outcomes.
